SPPO Guidance List

The list of documents here includes all “guidance documents,” as defined in Executive Order 13891, Promoting the Rule of Law Through Improved Agency Guidance Documents, 84 Fed. Reg. 55235 (Oct. 9, 2019), issued by the Student Privacy Policy Office (SPPO). As a general matter, guidance documents are statements of general applicability, intended to have future effect on the behavior of regulated parties, that sets forth a policy on a statutory, regulatory, or technical issue; or an interpretation of a statute or regulation. The guidance documents issued by SPPO address requirements of the Family Educational Rights and Privacy Act (FERPA), the Protection of Pupil Rights Amendment (PPRA), and the Armed Forces Recruiter Access to Students and Student Recruiting Information provisions under Section 8528 of the Elementary and Secondary Education Act, as amended. This list of documents does not include advisory or legal opinions directed to particular parties about circumstance-specific questions, correspondence with individual persons or entities, or letters pertaining to complaints filed with SPPO, unless those documents constitute statements of general applicability intended to have future effect on the behavior of regulated parties.
